Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of DeepSearch at deepsearchai.net and its related features (the "Service"). In these Terms, "we," "us," and "our" refer to DeepSearch.

By accessing or using the Service, creating an account, or otherwise indicating your acceptance, you agree to these Terms. If you do not agree, do not use the Service.

These Terms apply whether you use the Service as an individual or on behalf of an organization. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes both you and the organization.

2. Eligibility

The Service is not directed to children. You must be at least 13 years old and meet any higher minimum age required where you live to consent to data processing or enter into these Terms.

If you are old enough to use the Service but have not reached the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.

You may not use the Service if applicable law prohibits you from doing so.

3. Accounts and Security

Some features may require an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for:

• Maintaining the confidentiality of your credentials
• Activities performed through your account, except to the extent caused by our breach of these Terms or applicable law
• Promptly notifying us if you suspect unauthorized access or a security incident

You may not share credentials in a way that compromises the Service, impersonate another person or organization, or create accounts through unauthorized automated means.

4. Access to the Service

DeepSearch helps you research people using publicly available information. Reports may bring together professional profiles, work and education history, web mentions, available photos, source links, and AI-generated summaries.

Results depend on the public information available and the clues you provide. People may share the same name, sources may be incomplete or out of date, and AI summaries may contain errors. A search may return limited information or no reliable match. Check the original sources and the person's identity before relying on a report. Reports support general research and do not establish a person's identity or verify every statement about them.

Content labeled as a demo is illustrative and does not verify information about the person you search for. Feature availability and usage limits are shown in the Service.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purposes.

The Service may change over time. We may add, modify, suspend, or discontinue features, subject to applicable law and any specific commitments made when you purchased a paid feature. We do not guarantee that every feature will always be available or compatible with every device or integration.

You are responsible for obtaining the equipment, connectivity, and permissions needed to use the Service.

5. Acceptable Use

The Service is a non-adult-content service. You must not use the Service to create, upload, store, transmit, distribute, promote, or facilitate:

• Pornographic, sexually explicit, sexually exploitative, or sexually abusive content
• Any sexual exploitation or abuse of minors, or any content that depicts, promotes, or facilitates such conduct
• Illegal activities, goods, services, or content
• Fraud, deception, phishing, spam, or other abusive communications
• Harassment, stalking, hate, discrimination, or credible threats of violence
• Content that infringes intellectual property, privacy, publicity, confidentiality, or other rights
• Malware, malicious code, destructive payloads, or attempts to compromise systems or data
• Unauthorized scraping, probing, testing, reverse engineering, or access to accounts, systems, or networks

You also must not:

• Interfere with the operation, security, or integrity of the Service
• Bypass usage limits, access controls, or safety measures
• Use the Service in a way that materially harms us, other users, or third parties
• Resell or commercially exploit the Service unless expressly permitted
• Help another person engage in conduct prohibited by these Terms

We may investigate suspected violations and take proportionate action, including removing content, limiting features, suspending accounts, or terminating access. Where appropriate or legally required, we may preserve information and cooperate with lawful requests from authorities.

6. User Content

"User Content" means search inputs, profile information, images, messages, feedback, or other material you submit to the Service. Public source materials and AI-generated report content are addressed separately in Section 7.

You retain any rights you have in User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify solely for technical formatting, and otherwise use User Content only as reasonably necessary to:

• Provide, operate, maintain, secure, and improve the Service
• Follow your instructions and enable requested features
• Prevent abuse and enforce these Terms
• Comply with applicable law

This license lasts while the User Content is stored or processed by the Service and for a reasonable period in backups, logs, or records maintained for security, dispute resolution, or legal compliance.

You represent that you have the rights and permissions needed to submit User Content and allow the uses described above. You remain responsible for User Content and its legality.

If you provide ideas or feedback about the Service, we may use them without restriction or compensation, provided that doing so does not identify you publicly without permission.

7. Intellectual Property

Our software, design, branding, and original materials are owned by us or our licensors and are protected by intellectual property laws.

Public profiles, articles, photographs, and other source materials remain subject to the rights of their respective owners. Their appearance in a report does not transfer ownership to us or to you. Viewing or unlocking a report does not give you permission to reproduce or commercially use third-party materials. AI-generated text may not be unique and remains subject to any rights that apply to its content.

Except for the limited right to use the Service under these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service unless applicable law permits it or we give written permission.

8. Paid Features, Subscriptions, and Billing

This section applies when you purchase paid features, subscriptions, or credits that are actually offered through the Service. Available plans are described on the pricing page, with the applicable purchase details shown before you place an order. Viewing a price or selecting a plan in a labeled demo does not itself create an order or authorize a charge. Features explicitly offered as free tests do not create a paid subscription.

Prices, billing periods, included features, usage limits, trial terms, and other purchase details shown when you place an order form part of your agreement with us. You authorize us and our payment processors to charge the payment method you provide for the amounts shown at checkout, including applicable taxes and fees.

Payment processors may collect and process payment credentials directly under their own terms and privacy policies. We may receive transaction identifiers, customer identifiers, subscription status, invoice details, and other information needed to provide paid features.

If a purchase is described as a recurring subscription, it will automatically renew for the period disclosed at purchase until canceled. You may cancel through the account controls or customer portal made available by the Service. Unless the purchase terms or applicable law state otherwise, cancellation takes effect at the end of the current paid period and does not retroactively refund prior charges.

Our Refund & Cancellation Policy forms part of these Terms and explains refund eligibility, cancellation, search credit returns, and the effect of a payment refund on your credits and subscription. Refunds and cancellations are governed by that policy, any specific conditions clearly disclosed when you purchase, and applicable law. Updated policies do not retroactively reduce rights associated with an earlier purchase.

Trial conversions and price changes are governed by the terms shown at purchase and applicable law. We will provide notice of material subscription or price changes when required.

If payment fails or remains overdue, we may limit or suspend paid features after any notice or cure period required by applicable law.

9. Third-Party Services

We use third-party search and AI services to help retrieve public information and prepare reports. Other service providers support functions such as sign-in, payment, hosting, storage, communications, and analytics when those functions are used. See Section 10 for our privacy and cookie policies.

Reports may link to independent websites or display images hosted by them. Your use of those websites and their content may be governed by their own terms and privacy policies.

We are not responsible for third-party services that we do not control. We do not endorse third-party content merely because it is linked to or accessible through the Service.

10. Privacy and Similar Technologies

Our Privacy Policy explains how personal information is handled. Our Cookie and Similar Technologies Policy explains how cookies, local storage, pixels, scripts, and related technologies may be used.

11. Suspension and Termination

You may stop using the Service at any time. To request account deletion, email support@deepsearchai.net. Our Privacy Policy explains the handling of deletion requests and retained information.

We may restrict, suspend, or terminate access if we reasonably believe that:

• You materially or repeatedly violated these Terms
• Your use creates a security, legal, or operational risk
• Payment for a paid feature is overdue
• Suspension is necessary to protect users, third parties, or the Service
• We are required to do so by law

When reasonably practicable, we will provide notice and an opportunity to address the issue. We may act immediately in urgent cases involving security, fraud, illegal conduct, sexual exploitation, or risk of harm.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive will remain in effect, including provisions concerning intellectual property, User Content licenses needed for retained backups or legal records, payment obligations, disclaimers, liability, indemnity, and general terms.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that content or results will be accurate or suitable for your needs.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot lawfully be excluded, including mandatory consumer rights.

13. Limitation of Liability

To the maximum extent permitted by law, neither we nor our affiliates, licensors, or service providers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the Service.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of:

• The amount you paid for the Service during the 12 months before the event giving rise to the claim
• The minimum amount of liability that applicable law requires

These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence where applicable law prohibits limitation.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement of another person's rights.

This section does not require a consumer to indemnify us to the extent prohibited by applicable consumer law.

15. Governing Law and Disputes

These Terms are governed by the laws that apply to the operator of the Service and your relationship with the Service, without depriving you of mandatory protections available where you live.

Before filing a formal claim, you and we agree to try to resolve the dispute informally by providing a written description of the issue to support@deepsearchai.net. Either party may seek urgent injunctive or equitable relief where appropriate.

Any unresolved dispute may be brought before a court or tribunal that has jurisdiction under applicable law. These Terms do not require arbitration or waive a right to participate in a class or representative action where such a waiver would be invalid.

16. Changes to These Terms

We may update these Terms to reflect changes to the Service, law, security practices, or business operations. The updated Terms will be posted on this page with a revised effective date.

If a change materially affects your rights, we will provide additional notice when required by law. Your continued use after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.

17. General

These Terms, together with any purchase terms and policies expressly incorporated into them, form the entire agreement concerning the Service.

If a provision is unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, but we may assign them as part of a merger, acquisition, reorganization, or transfer of the Service, subject to applicable law.
